Payment Agreement and Financial Terms and Conditions

These Payment Agreement and Financial Terms and Conditions form part of your agreement with Trauma Therapy Training Pty Ltd ("TTT", "we", "us" or "our") for the TRTP Practitioner Training Program.

These Financial Terms should be read together with the TRTP Practitioner Training Program Terms and Conditions, your accepted written offer, invoice and payment schedule.

Payment Terms and Conditions

Submitting an application does not automatically guarantee acceptance into the Program or reserve a place in a particular training cohort.
TTT will notify you if your application has been accepted and will provide you with a written offer, invoice or payment schedule setting out the applicable Course Fee.
Your place in the selected training cohort is secured only after TTT has accepted your application and the required initial payment has been received as cleared funds.
Where you select the six-month payment plan, a deposit equal to 50% of the total payment-plan price is required by the due date stated in your written offer or invoice.
The six-month payment plan incurs an additional cost of AUD $330 including GST where GST is payable, unless a different amount is expressly stated in your written offer.
The remaining balance under the six-month payment plan will be paid in six monthly instalments. The exact deposit, instalment amounts and payment dates will be stated in your written payment schedule.
A payment plan is an arrangement for payment of the fixed Course Fee. It is not a subscription, membership or pay-as-you-go arrangement.
Discounts may be offered by TTT at its discretion. A discount applies only where it is confirmed in writing and remains subject to any conditions stated in the relevant offer.
Unless expressly stated otherwise, discounts cannot be combined.
All cancellation, refund and deferment calculations will be based on the Course Fee stated in your accepted written offer or invoice after any applicable discount.

Failed or Overdue Payments

You are responsible for ensuring that sufficient funds are available for each scheduled payment.

If a payment is declined, reversed or not received by its due date, TTT may:

notify you that the payment is overdue;
require payment within the reasonable period stated in the notice;
suspend access to the training portal, live sessions, communities, support services or certification activities until the overdue amount is paid; and
take further action under the TRTP Practitioner Training Program Terms and Conditions if the overdue amount remains unpaid.

TTT will not charge more than the actual amount of any bank dishonour or payment-reversal fee directly incurred by TTT.

Suspension of access due to non-payment does not automatically extend the Program timetable or release you from amounts properly payable under your accepted payment arrangement.

Cancellation and Refund Policy

Before enrolling in TRTP Practitioner Training, you must ensure that you have the capacity to meet the attendance, participation, practice and payment requirements of the selected Program.

TTT allocates cohort capacity, administration, partner-practice arrangements, training resources and support following acceptance of an enrolment.

The Program also includes the upfront provision of substantial confidential and proprietary TRTP intellectual property, including the complete core training handbooks and practitioner scripts.

These core materials are provided in full when access to the training portal is activated. Although online modules and facilitated training are delivered progressively, the complete core handbooks and practitioner scripts are not progressively released.

Once access to those materials has been provided, the information disclosed cannot practically be returned, recalled or made unknown to the recipient. For this reason, different cancellation arrangements apply before and after access to the core training materials.

Cancellation Before Access to the Core Training Materials

If TTT receives your written cancellation request before valid portal access and access to the complete core TRTP handbooks and practitioner scripts have been provided:

TTT will refund amounts paid, less an AUD $550 cancellation and administration charge including GST where GST is payable.

The cancellation and administration charge reflects work undertaken in assessing and processing the application, establishing the enrolment and payment arrangements, creating training records and reserving a place in the selected cohort.

Cancellation or Withdrawal After Access to the Core Training Materials

If you cancel or withdraw for change-of-mind reasons after valid portal access and access to the complete core TRTP handbooks and practitioner scripts have been provided:

no change-of-mind refund is payable in respect of any Course Fee already paid;
the full Course Fee remains payable;
where you are paying under a payment plan, all remaining instalments remain payable in accordance with the accepted payment schedule;
withdrawal, non-attendance or failure to complete the Program does not convert the payment plan into a pay-as-you-go arrangement;
failure to open, download, read, view or use the materials does not create an entitlement to a change-of-mind refund where valid access was provided; and
the AUD $550 cancellation and administration charge will not be added to the full Course Fee.

This policy applies because the complete core handbooks and practitioner scripts contain substantial confidential and proprietary information and are supplied upfront as an integral component of the Program.

Cancellation or withdrawal does not grant or preserve any right to use TRTP materials, scripts, methods, titles, logos or other intellectual property outside the permissions expressly provided in the TRTP Practitioner Training Program Terms and Conditions.

Meaning of Change of Mind

For the purpose of this policy, a change-of-mind cancellation or withdrawal includes circumstances where you:

decide that you no longer wish to undertake the Program;
decide that the Program is no longer suitable for your personal or professional plans;
become unable to attend because of work, family, financial, health or personal circumstances;
do not attend or participate in scheduled training activities;
do not complete required modules, partner practice or assessments;
do not use the portal after valid access has been provided; or
otherwise choose not to continue for reasons that are not caused by a failure by TTT to provide the agreed Program.

Cancellation or Material Failure by TTT

The change-of-mind cancellation arrangements above do not apply where:

TTT cancels the selected training program and does not provide a reasonably equivalent alternative that you agree to accept;
TTT makes a material change that substantially reduces the Program agreed to be provided;
TTT materially breaches its agreement with you;
the Program or services fail to comply with an applicable consumer guarantee; or
you otherwise have a cancellation, refund or other remedy available under applicable law.

In those circumstances, TTT will provide the refund, replacement service, credit or other remedy required under the agreement and applicable law.

Deferment of Training

TTT recognises that circumstances may arise that prevent a student from continuing with their original cohort. Where appropriate, an approved deferment may provide an alternative to cancellation.

A request for deferment must:

be submitted to TTT in writing;
explain the reason for the request; and
be submitted as soon as reasonably practicable after you become aware that you may be unable to continue with the original cohort.

TTT will consider each deferment request individually, having regard to:

the circumstances giving rise to the request;
the stage of the Program reached;
the training, content and support already provided;
partner-practice and cohort arrangements;
the availability of a suitable future cohort; and
the additional cost of transferring the enrolment.

Unless TTT agrees otherwise in writing:

only one deferment is permitted;
the replacement cohort must commence within 12 months of the commencement date of the original cohort;
the minimum deferment fee is 10% of the Course Fee stated in your accepted written offer; and
any additional deferment cost must reasonably reflect duplicated training, cohort, administration, support or assessment costs.

TTT will disclose the proposed deferment fee and any additional payment required before the deferment is finalised.

A deferment does not cancel the original Course Fee or create an entitlement to a refund.

Australian Consumer Law

Nothing in these Financial Terms excludes, restricts or modifies any consumer guarantee, statutory right or remedy that cannot lawfully be excluded, restricted or modified.

References to no refund being payable apply to voluntary change-of-mind cancellations and withdrawals. They do not limit any right or remedy arising from a failure by TTT to comply with an applicable consumer guarantee, a material breach by TTT or another circumstance in which a refund or remedy is required by law.

Acceptance of Financial Terms

By accepting the written offer, making a payment or proceeding with enrolment, you confirm that:

you have read and understood these Financial Terms;
you have reviewed the Course Fee, deposit, payment-plan price where applicable, instalment amounts and payment dates;
you understand that the complete core TRTP handbooks and practitioner scripts are supplied upfront when portal access is activated;
you understand the cancellation, no-change-of-mind-refund and deferment arrangements; and
you agree to make all payments properly due under your accepted payment arrangement.

TRTP Practitioner Training Program Terms and Conditions

Training Provider: Trauma Therapy Training Pty Ltd (ABN 41 162 600 964) ("TTT", "we", "us" or "our").

These Terms and Conditions apply to your application, enrolment, participation, training, assessment and certification pathway in connection with the TRTP Practitioner Training Program.

These Terms should be read together with:

the separate Payment Agreement and Financial Terms and Conditions;
the separate Immediate Access and Change-of-Mind Refund Acknowledgement;
the TRTP Code of Conduct;
our Privacy Policy;
the certification requirements provided by TTT;
any membership terms applicable to you; and
any brand guidelines or professional-use instructions provided by TTT.

The Payment Agreement and Financial Terms and Conditions govern all matters relating to course fees, deposits, payment plans, failed or overdue payments, cancellations, refunds and deferments.

1. Definitions

In these Terms:

Active Membership means a current TRTP practitioner membership that TTT recognises as active for practitioner and brand-use purposes. The membership may be paid or expressly provided by TTT on a complimentary basis, but must not be expired, suspended or cancelled, and all amounts due under the relevant membership arrangement must be current.
Approved Brand Assets means the TRTP trade marks, practitioner titles, logos, practitioner badges, graphics, images, templates, marketing materials and other brand assets that TTT has specifically approved and supplied for practitioner use.
Certified Practitioner means a person who has:
- completed the Formal Training Component;
- completed the Certification Pathway;
- passed TTT's certification assessment;
- received a Certification Certificate; and
- not had their certification suspended or withdrawn.
Certification Certificate means the certificate issued by TTT after a person has successfully completed the Certification Pathway and passed the required competency assessment.
Certification Pathway means the post-training client practice and assessment requirements established by TTT, including:
- completion of ten client cases;
- submission of the required recording of the tenth client case for assessment;
- submission of any required supporting documents or case information; and
- demonstration of the required level of competence.
Completion Certificate means the certificate issued after TTT confirms that a student has successfully completed the Formal Training Component.
Core Training Materials means the complete core TRTP handbooks, practitioner scripts, worksheets and associated proprietary materials that are made available when training portal access is activated.
Course Materials means all TRTP training and practitioner materials in any format, including:
- the Core Training Materials;
- manuals, scripts, worksheets and forms;
- videos and audio recordings;
- presentations and diagrams;
- demonstrations and examples;
- templates and assessment resources;
- online modules and portal content;
- live training content; and
- supporting documentation.
Formal Training Component means the scheduled training program, including its online modules, live training, partner practice, learning activities and required training assessments.
Program means the TRTP Practitioner Training Program, including the Formal Training Component, Certification Pathway, assessment activities and associated support.
TRTP IP means the intellectual property, confidential information and proprietary rights owned by or licensed to TTT in connection with TRTP and The Richards Trauma Process, including:
- the Course Materials;
- the Approved Brand Assets;
- trade marks and copyright works;
- scripts, manuals, worksheets and training resources;
- confidential methods and know-how;
- training structures and delivery systems;
- certification and assessment materials;
- proprietary terminology and presentation structures; and
- confidential business and practitioner information.
You or student means the person applying for, enrolled in or participating in the Program.

2. Our Goals

Our goals are:

to provide a high standard of TRTP training;
to equip students with the knowledge, structure and practical skills required to work toward TRTP practitioner certification;
to promote professional, ethical and responsible conduct;
to support consistency and integrity in the delivery of The Richards Trauma Process;
to provide appropriate feedback and support as students develop their skills;
to protect clients from the unauthorised or inadequately trained use of TRTP;
to protect the integrity, reputation and intellectual property of TRTP; and
to contribute positively to the standard of trauma-informed mental health practice.

3. Nature of the Training

The Program provides training in the principles, structure and application of The Richards Trauma Process.

Completion of the Program or certification by TTT does not, by itself:

provide professional registration;
provide government accreditation;
qualify a person to practise in a regulated profession for which they do not otherwise hold the required qualifications;
replace any registration, supervision, insurance, licensing or continuing professional development requirements that apply to the student;
authorise a person to work outside their professional competence or lawful scope of practice; or
guarantee acceptance by a professional association, employer, insurer or regulatory body.

Each student is responsible for determining whether they are legally and professionally permitted to provide services to a particular client and whether any registration, insurance, supervision, consent, referral or other professional requirement applies.

Training in TRTP does not replace the student's responsibility to assess client suitability, identify risk, work within scope and refer a client where appropriate.

4. Admission and Participation

Admission to the Program is subject to TTT's entry requirements and acceptance of the applicant.

Submitting an application does not automatically guarantee acceptance into the Program or reserve a place in a particular cohort.

Subject to applicable law, TTT may refuse admission, suspend participation or terminate a student's enrolment where TTT reasonably considers that the student:

does not satisfy the Program's entry requirements;
has provided false, misleading or materially incomplete information;
has failed to pay an amount when due under the separate Payment Agreement and Financial Terms and Conditions;
has repeatedly failed to attend or participate in required Program activities;
has engaged in disruptive, abusive, discriminatory, unsafe or unprofessional behaviour;
has breached confidentiality, privacy or intellectual property obligations;
has breached the TRTP Code of Conduct;
has engaged in dishonest conduct in relation to training, client work, recordings or assessment;
is practising in a manner that may place clients, students, trainers or the reputation of TRTP at unreasonable risk; or
has otherwise committed a serious or repeated breach of these Terms.

Where reasonably practicable, TTT will explain the concern and provide the student with an opportunity to respond or remedy the breach before taking final action.

TTT may take immediate interim action where this is reasonably necessary to protect:

a client or participant;
confidential information;
TRTP IP;
the integrity of an assessment;
the integrity of the Program; or
the reputation and professional standing of TRTP.

The financial consequences of cancellation, withdrawal, suspension, deferment or termination are governed by the separate Payment Agreement and Financial Terms and Conditions.

5. Our Commitments

TTT will:

be open to constructive and appropriately delivered feedback;
take responsibility for those aspects of the Program that are reasonably within our control;
provide reasonable channels through which students may submit questions or raise concerns;
treat students respectfully while providing honest and constructive feedback;
handle personal and confidential information in accordance with applicable privacy obligations and our Privacy Policy;
apply assessment requirements reasonably and consistently;
use reasonable efforts to provide training that supports the development of safe and competent TRTP practice; and
take reasonable steps to protect the integrity and confidentiality of the Program and its participants.

6. Your Commitments

By participating in the Program, you agree:

to treat fellow students, clients, trainers, assessors, mentors and TTT representatives with respect;
to conduct yourself professionally, ethically and in a manner consistent with the integrity of TRTP;
to accept responsibility for your conduct and professional decisions;
to be open to constructive feedback and competency assessment;
to attend and participate in required training, practice and assessment activities;
to complete required modules, partner practice, client work and assessments honestly;
not to submit another person's work, case or recording as your own;
not to falsify attendance, practice, client or assessment records;
to maintain the confidentiality of students, clients, trainers and practitioners;
to comply with the separate Payment Agreement and Financial Terms and Conditions;
to maintain any qualifications, professional registration, supervision, insurance or approvals required for your work;
to obtain appropriate informed consent before conducting, recording or discussing client work;
to disclose your training, certification and membership status accurately to clients and the public;
not to use TRTP practitioner titles, logos, badges or other Approved Brand Assets unless expressly authorised under these Terms;
not to use the Course Materials or TRTP methodology with clients unless expressly authorised under these Terms;
to comply with the TRTP Code of Conduct;
to comply with any applicable professional code of ethics, conduct or practice;
to comply with applicable privacy, confidentiality and recording laws; and
to use the Course Materials and TRTP IP only as permitted by these Terms.

7. Confidentiality

The Program requires students and trainers to discuss personal experiences, professional situations, practice exercises and client-related material. A respectful and secure training environment depends upon those communications remaining confidential.

You agree to keep confidential:

personal information disclosed by another student;
information disclosed during partner practice or breakout activities;
client information, recordings and case material;
communications from trainers, assessors, mentors and practitioners;
private discussions within TRTP communities and support sessions;
unpublished Course Materials, certification requirements and assessment materials;
confidential methods, scripts, procedures and practitioner information; and
other information that is identified as confidential or would reasonably be understood to be confidential.

You must not post, publish, forward, reproduce, screenshot, record or otherwise disclose confidential Program information without appropriate consent and, where the material includes TRTP IP, TTT's prior written permission.

When discussing client situations in training, support calls or communities, you must remove identifying information unless disclosure is necessary, lawful and supported by the client's informed consent.

You must not use information obtained through the Program to contact, solicit, embarrass, criticise or disadvantage another student, client, trainer, assessor, mentor or practitioner.

These confidentiality obligations do not prevent disclosure:

where the person concerned has provided informed consent;
where disclosure is required or authorised by law;
where disclosure is reasonably necessary to address a serious risk to health or safety;
to an appropriately qualified legal, medical, insurance, regulatory or professional adviser who is subject to confidentiality obligations;
for the purpose of making a protected disclosure or reporting suspected unlawful or unethical conduct; or
as otherwise expressly authorised in writing by TTT.

Your confidentiality obligations continue after you complete, cancel, withdraw from or are removed from the Program.

8. Completion of the Formal Training Component

A student will have completed the Formal Training Component when TTT confirms that the student has satisfactorily completed the attendance, participation, module, partner-practice and assessment requirements applicable to the Program.

Upon successful completion of the Formal Training Component, TTT will issue the student with a Completion Certificate.

A Completion Certificate confirms completion of the Formal Training Component only.

A Completion Certificate does not:

constitute TRTP practitioner certification;
make the recipient a Certified Practitioner;
confirm that the recipient has completed or passed the Certification Pathway;
authorise the recipient to describe themselves as a Certified TRTP Practitioner or current TRTP Practitioner;
grant permission to use a TRTP practitioner logo, practitioner badge or other Approved Brand Asset;
provide automatic admission to the TRTP Practitioner Directory;
create an unrestricted right to use the Course Materials or TRTP methodology with clients;
provide an unrestricted licence to use TTT's trade marks or other TRTP IP; or
guarantee that the student will later satisfy the requirements for practitioner certification.

9. Practitioner Certification

Practitioner certification is separate from completion of the Formal Training Component.

To be eligible for practitioner certification, a student must:

successfully complete the Formal Training Component;
receive confirmation from TTT that they may commence the Certification Pathway;
complete ten client cases in accordance with the Certification Pathway and associated requirements communicated by TTT;
obtain and retain appropriate informed consent from each client;
submit the required recording of the tenth client case for assessment;
submit any required supporting documents, reflections or case information;
demonstrate an acceptable level of competence, professional judgement, client care and adherence to the TRTP structure;
comply with these Terms, the TRTP Code of Conduct and applicable professional obligations; and
satisfy any other certification requirements provided in writing by TTT.

Completion of ten client cases and submission of the tenth client recording do not automatically result in certification.

The recording and associated assessment materials must be reviewed and approved by TTT.

If the required competency standard has not yet been demonstrated, TTT may require:

further practice;
additional feedback;
further training or mentoring;
additional client work;
submission of a further recording; or
reassessment.

TTT will apply its assessment standards reasonably and may provide the student with feedback about areas requiring further development.

Once the student has successfully passed the certification assessment, TTT will issue a Certification Certificate.

Certification takes effect only from the date on which TTT confirms the successful certification outcome.

A person must not represent themselves as certified before receiving that confirmation.

A Certification Certificate records that the practitioner met TTT's certification standard at the time of assessment. It does not create a perpetual or unrestricted right to use TRTP practitioner titles, trade marks, logos, badges or Approved Brand Assets.

10. Client Work During the Certification Pathway

A person who has received a Completion Certificate but has not yet passed the certification assessment is not a Certified Practitioner.

A student may conduct client cases for the Certification Pathway only after:

successfully completing the Formal Training Component;
receiving a Completion Certificate;
receiving confirmation from TTT that they may commence the Certification Pathway; and
satisfying any applicable professional, insurance, consent and scope-of- practice requirements.

During the Certification Pathway, the student must:

use only trainee, student or practitioner-in-training wording expressly approved by TTT;
clearly tell certification clients that they have completed the Formal Training Component but have not yet received TRTP practitioner certification;
obtain the client's informed consent to receiving services from a person completing the Certification Pathway;
obtain any separate consent required for recording or assessment;
use the Course Materials only for authorised certification cases;
work within their qualifications, competence and lawful scope of practice;
comply with any supervision, support or referral requirements applicable to them;
comply with instructions given by TTT regarding client suitability, recording, assessment and safety;
not use TRTP practitioner logos, certification badges or other Approved Brand Assets; and
not represent that TTT has certified, endorsed or approved their professional practice before certification has been confirmed.

Permission to use the Course Materials with certification clients is a limited training and assessment permission only. It is not a general professional licence and ends if the student:

cancels or withdraws from the Certification Pathway;
is removed from the Certification Pathway;
fails to comply with the applicable requirements;
is directed by TTT to stop client work; or
does not proceed to certification.

11. Certification, Active Membership and Public Representation

Permission to publicly represent yourself as a current TRTP practitioner and to use Approved Brand Assets is available only while you:

are a Certified Practitioner whose certification has not been suspended or withdrawn; and
hold an Active Membership.

Both requirements must be satisfied.

Certification without Active Membership does not provide an ongoing right to:

describe yourself as a current TRTP Practitioner;
describe yourself as a current Certified TRTP Practitioner;
use a TRTP practitioner title in advertising or promotion;
use TRTP logos, badges or Approved Brand Assets;
imply that you are currently recognised, endorsed or supported by TTT; or
remain listed in the TRTP Practitioner Directory.

Subject to compliance with these Terms and TTT's current brand guidelines, a Certified Practitioner with an Active Membership may:

use practitioner titles specifically approved by TTT;
display the current practitioner logo or badge supplied by TTT;
use Approved Brand Assets to promote their own professional TRTP services;
accurately describe their current certification and membership status; and
apply for or retain a listing in the TRTP Practitioner Directory, subject to the directory's eligibility and listing requirements.

The following people are not authorised to use current practitioner titles or branding:

applicants who have not commenced the Program;
students currently completing the Formal Training Component;
people who hold only a Completion Certificate;
people completing the Certification Pathway;
people who have not passed the certification assessment;
people whose certification has been suspended or withdrawn;
Certified Practitioners whose membership is inactive, expired, suspended or cancelled; and
clinics, employers, businesses or organisations that have not received separate written permission from TTT.

A person who has completed training or was previously certified may make an accurate, plain-text historical statement about that fact.

A historical statement must not imply that the person:

is currently certified;
is currently recognised by TTT;
holds an Active Membership;
is currently listed in the practitioner directory; or
is authorised to use current practitioner branding.

If your Active Membership expires, is suspended or is cancelled, you must:

immediately stop creating or publishing new uses of Approved Brand Assets;
immediately stop describing yourself as a current TRTP Practitioner or Certified TRTP Practitioner;
remove practitioner logos, badges and Approved Brand Assets from websites, social media, advertising, directories, email signatures, printed materials and other public-facing locations within 14 days;
update wording that inaccurately implies current membership, endorsement or practitioner status; and
comply with any reasonable correction or removal direction issued by TTT.

TTT may require a shorter removal period where the use is misleading, unauthorised, unsafe or may cause material damage to a client, the public or the reputation of TRTP.

12. Licence to Use TRTP Trade Marks, Logos and Brand Assets

TTT retains all ownership and rights in its trade marks, logos, practitioner badges and Approved Brand Assets.

While you are both a Certified Practitioner and an Active Member, TTT grants you a limited, non-exclusive, non-transferable, non-sublicensable and conditional licence to use Approved Brand Assets solely for the promotion of your own authorised TRTP practitioner services.

The licence exists only while the certification and Active Membership conditions are satisfied.

This licence does not permit you to:

claim ownership of a TRTP trade mark, logo or Approved Brand Asset;
alter, redraw, recolour, crop, distort, animate, translate, recreate or rebrand an Approved Brand Asset;
remove or alter a copyright, trade mark or ownership notice;
use an outdated logo, badge, template or Approved Brand Asset after TTT has directed that it be replaced;
incorporate TRTP wording, trade marks or logos into a business name, company name, domain name, social media handle, product name, course name or membership name without prior written permission;
register or attempt to register any trade mark, business name, domain name or social media identifier that incorporates or is confusingly similar to TRTP branding;
use Approved Brand Assets on merchandise, products, books, courses, workshops, training programs or certification services without prior written permission;
authorise another person, employee, contractor, clinic or organisation to use the Approved Brand Assets;
use Approved Brand Assets in a manner that suggests that a non-certified practitioner, clinic or organisation is certified or endorsed by TTT;
imply that you are an employee, partner, agent, representative, trainer or spokesperson of TTT unless TTT has expressly appointed you in that capacity;
use TRTP branding to promote a different therapy, methodology, training program or commercial product in a manner likely to cause confusion;
make false, misleading, exaggerated or unsubstantiated claims about TRTP or expected client outcomes; or
use Approved Brand Assets in a manner that is unlawful, unethical, discriminatory, misleading or likely to materially damage the integrity of TRTP.

Where a Certified Practitioner works within a clinic, group practice or organisation, any use of Approved Brand Assets must clearly identify the individual Certified Practitioner.

The clinic or organisation does not acquire a licence merely because it engages or employs a Certified Practitioner.

TTT may review a practitioner's use of Approved Brand Assets and require reasonable corrections to ensure compliance with these Terms and the current brand guidelines.

The licence ends automatically if:

your certification is suspended or withdrawn;
your Active Membership expires;
your Active Membership is suspended or cancelled; or
you otherwise cease to satisfy the licence conditions.

13. Ownership and Protection of TRTP Intellectual Property

TTT owns, or has the right to use and license, the TRTP IP.

TRTP IP includes, without limitation:

the names TRTP and The Richards Trauma Process;
approved practitioner and certification titles;
TRTP word marks, logos, visual marks, graphics and practitioner badges;
Dynamic Re-imagining and other proprietary terminology;
the Core Training Materials;
Course Materials, manuals, scripts, worksheets and assessments;
training videos, audio recordings, presentations and demonstrations;
confidential methods, processes and practitioner know-how;
training structures and delivery systems;
certification and competency standards;
website, portal, community and database content;
confidential business, training, assessment and certification information; and
registered and unregistered intellectual property and contractual rights associated with the above.

Enrolment, payment, portal access, completion, certification or membership does not transfer ownership of TRTP IP to you.

Access to and copies of the Course Materials are licensed for limited authorised purposes. They are not sold to you and do not become your intellectual property.

You must not, without TTT's prior written permission:

copy, reproduce, publish, sell or distribute TRTP IP;
translate, adapt, reword, rebrand or create derivative training materials from TRTP IP;
use TRTP IP to create or deliver your own therapy training, certification, workshop, membership or practitioner training program;
provide Course Materials or portal access to another person or organisation;
remove copyright, confidentiality, trade mark or ownership notices;
represent that an altered or independently created process is an approved TRTP process;
use substantial parts of the TRTP methodology or Course Materials in a competing training, certification, therapy or commercial program;
teach, demonstrate or explain confidential TRTP methods to another practitioner for the purpose of enabling that person to provide TRTP;
use Course Materials or confidential TRTP information to develop, instruct, train or improve an artificial intelligence system, machine learning model or automated content system;
upload Course Materials or confidential TRTP information to a public or third-party artificial intelligence system without prior written permission; or
assist another person to do anything prohibited by these Terms.

TTT does not claim ownership of materials that you created independently before entering the Program merely because you participate in the Program.

TTT also does not claim ownership of general professional knowledge, skills or experience that you independently acquire outside the Program and that do not comprise TRTP IP or confidential TRTP information.

However, you must not incorporate TRTP IP into your own materials, courses, services, products or publications without prior written permission.

Any proposed adaptation, derivative material, publication or commercial project that includes substantial TRTP IP must be separately agreed with TTT in writing.

TTT may take reasonable action to protect and enforce its rights where TRTP IP is copied, disclosed, distributed, altered, commercialised or otherwise used without permission.

14. Permitted Use of Course Materials

Course Materials are provided under a personal, limited, conditional and non-transferable licence.

The permitted use of Course Materials depends upon your current stage in the training and certification process.

During the Formal Training Component

During the Formal Training Component, you may use Course Materials:

for your own learning and assessment;
during authorised partner practice;
during activities approved as part of the Program;
when following instructions given by a TTT trainer, assessor or mentor; and
for other training purposes expressly authorised by TTT.

Access to Course Materials during the Formal Training Component does not authorise you to provide TRTP to members of the public or use the Course Materials in independent client sessions.

During the Certification Pathway

After successful completion of the Formal Training Component, you may use approved Course Materials with certification clients only:

after TTT has confirmed that you may commence the Certification Pathway;
for the limited purpose of completing the required certification cases;
in accordance with the client consent and disclosure requirements in these Terms;
within your qualifications, competence and lawful scope of practice;
while complying with all applicable certification requirements; and
while your permission to participate in the Certification Pathway remains active.

Following Practitioner Certification

A Certified Practitioner whose certification has not been suspended or withdrawn may use approved Course Materials as an aid in their own private and confidential client work, subject to:

these Terms;
the TRTP Code of Conduct;
applicable professional obligations;
their qualifications and scope of practice;
client suitability and informed consent;
current professional-use instructions issued by TTT; and
the continuing protection of TRTP IP.

Permission to use Course Materials during authorised client work does not grant permission to publicly reproduce or distribute those materials.

Permission to use Course Materials does not grant branding rights. Public use of TRTP practitioner titles, logos, practitioner badges and Approved Brand Assets requires both practitioner certification and Active Membership.

Prohibited Uses

You must not:

share your course portal username or password;
provide another person with access to Course Materials;
forward, upload, reproduce, print for distribution, publish, sell, licence, give or distribute Course Materials to another person;
provide clients with copies of Course Materials unless the particular client resource has been expressly approved by TTT for that purpose;
upload Course Materials, confidential training content or client recordings to a public or third-party artificial intelligence system unless TTT has expressly approved the system and the proposed use;
record a live training, practitioner support call, assessment, webinar, mentoring session or demonstration without prior written permission;
use Course Materials to train, mentor or certify another person in TRTP;
use Course Materials to enable an uncertified person to provide TRTP;
remove or obscure copyright, confidentiality or ownership notices;
create an altered, shortened, combined or rebranded version of the materials for public or professional distribution; or
use Course Materials for any purpose not expressly authorised under these Terms.

Any permission to access an online portal or resource library applies only for the access period stated in the Program offer, membership terms or other written communication from TTT.

If you are uncertain whether a proposed use is permitted, you must obtain written permission from TTT before using the material.

15. Effect of Cancellation, Withdrawal or Failure to Complete

Payment of the Course Fee and access to the Course Materials do not transfer ownership of TRTP IP and do not purchase an unrestricted or permanent professional licence.

The fact that the full Course Fee has been paid or remains payable under the separate Payment Agreement and Financial Terms and Conditions does not preserve a right to use TRTP professionally after your participation or permission has ended.

Cancellation or Withdrawal Before Completion of the Formal Training Component

If you cancel, withdraw from or are removed from the Program before successfully completing the Formal Training Component:

any permission to use the Course Materials or TRTP methodology with clients ends immediately;
you must not provide, advertise or represent that you provide TRTP services;
you must not use TRTP scripts, handbooks, worksheets, processes or other Course Materials in client sessions;
you must not attempt to provide a substantially copied, derived or rebranded version of TRTP using the Course Materials or confidential information obtained through the Program;
you must not describe yourself as a TRTP Practitioner, Certified TRTP Practitioner, TRTP practitioner-in-training or other TRTP practitioner title;
you must not use a TRTP logo, practitioner badge, trade mark or Approved Brand Asset;
you must immediately stop using the Course Materials for any professional or commercial purpose;
you must not share or provide the Course Materials to another person;
you must comply with any reasonable written direction from TTT concerning the deletion, destruction or return of copies of Course Materials; and
you must continue to comply with all confidentiality, copyright and intellectual property obligations contained in these Terms.

Withdrawal From the Certification Pathway Before Certification

If you complete the Formal Training Component but cancel, withdraw from or are removed from the Certification Pathway before receiving practitioner certification:

your limited permission to use Course Materials with certification clients ends immediately;
you must not accept or commence any further TRTP certification clients;
you must make appropriate arrangements for any current client, including referral or transition where necessary;
you must not continue to provide or advertise TRTP services;
you must not represent yourself as a TRTP Practitioner or Certified TRTP Practitioner;
you must not use TRTP practitioner titles, logos, badges or Approved Brand Assets; and
your confidentiality and intellectual property obligations continue.

Receiving a Completion Certificate does not preserve permission to use TRTP with clients after your participation in the Certification Pathway ends.

Retaining a physical or electronic copy of a Course Material does not create permission to use that material.

Cancellation, withdrawal, non-attendance, payment of the Course Fee or retention of information does not authorise you to:

provide TRTP to clients;
train another person in TRTP;
reproduce the TRTP methodology;
develop a derived or competing process from the Course Materials;
use TRTP practitioner branding; or
represent that you are approved, certified or endorsed by TTT.

Nothing in this section prevents you from using general professional knowledge and skills that:

you acquired independently of the Program;
do not reproduce or disclose Course Materials;
do not use confidential TRTP information;
do not represent or imitate TRTP; and
do not infringe TTT's intellectual property or contractual rights.

The financial consequences of cancellation, withdrawal or removal remain governed by the separate Payment Agreement and Financial Terms and Conditions.

16. Photography, Audio, Video and Digital Recordings

TTT may record scheduled training sessions, presentations, demonstrations, mentoring sessions, support calls or assessment activities for:

Program delivery;
student access;
training and feedback;
assessment;
quality assurance; and
administrative and professional review.

Where reasonably practicable, participants will be informed when a session is being recorded.

By participating in a session after being informed that it is being recorded, you consent to TTT recording your participation for the purposes described above.

Recordings may be viewed by authorised TTT trainers, assessors, mentors, administrators and service providers where reasonably necessary for the relevant training, assessment or support purpose.

TTT will not use an identifiable recording or image of a student in public advertising, promotional material or external training without obtaining separate permission from the student, unless the use is otherwise authorised or required by law.

You must not independently record, photograph, screenshot, copy, retain, transmit or distribute any training, assessment, community, mentoring or support session without:

TTT's prior written permission;
the informed consent of each identifiable participant; and
compliance with applicable privacy and recording laws.

Client Recordings Submitted for Feedback or Certification

Before recording or submitting any client session, you must:

obtain the client's informed written consent to the recording and its submission to TTT;
explain the purpose of the recording and who may review it;
tell the client that the recording may be viewed and discussed by authorised TTT trainers, assessors or mentors;
explain how the recording will be submitted and used;
comply with all applicable privacy, confidentiality, health information and recording laws;
remove or minimise identifying information where reasonably practicable;
use the secure submission method specified by TTT;
protect the recording from unauthorised access, copying or disclosure;
ensure that the recording is not used for any purpose outside the consent provided by the client; and
retain evidence of the client's consent for the period required by law and your professional record-keeping obligations.

Your acceptance of these Terms does not provide consent on behalf of a client.

You remain responsible for obtaining valid client consent and complying with any professional or legal recording requirement.

TTT will handle submitted recordings in accordance with its Privacy Policy, assessment requirements and applicable privacy obligations.

17. Ongoing Support, Community and Case Consultation

TTT may provide ongoing support through channels such as:

online student or practitioner communities;
video conferencing and group support calls;
TRTP-focused case consultation;
question-and-answer sessions;
workshops and professional development activities; and
additional mentoring services.

Unless a different support arrangement is stated in the written Program offer, access to the TRTP student community and TRTP-focused group support calls is included for six months following completion of the Formal Training Component.

Included support is provided at no additional cost during the stated support period.

Continued access after the included support period may require an Active Membership or payment of a separate fee.

Group support and case consultation sessions are provided for TRTP-focused:

education;
skill development;
case discussion;
questions and answers; and
practitioner support.

These sessions are not represented as formal clinical supervision or claimable professional development unless TTT expressly confirms otherwise in writing.

Students and practitioners remain responsible for obtaining any formal clinical supervision, professional development or case oversight required by their profession, employer, insurer or registration body.

Additional individual mentoring may be available from selected mentors for a separate fee and subject to separate arrangements.

TTT may make reasonable changes to support schedules, facilitators, platforms and delivery channels.

All participants must maintain client and participant confidentiality within support calls and online communities.

18. Professional Conduct, Ethics and Fitness to Practise

Students and practitioners must:

comply with the TRTP Code of Conduct;
comply with any professional code of ethics, conduct or practice that applies to them;
comply with applicable laws and professional obligations;
maintain appropriate professional indemnity and public liability insurance before working with clients;
work only within their qualifications, competence and scope of practice;
maintain appropriate client records and informed consent processes;
appropriately assess client suitability and risk;
refer a client to another service or professional where the client's needs are outside their competence or scope;
respond appropriately to risk, crisis, safeguarding or mandatory reporting concerns;
maintain appropriate professional boundaries;
maintain their personal wellbeing, effectiveness, resilience and capacity to practise safely;
seek appropriate support or cease practising where illness, impairment, substance use, emotional distress or another circumstance materially affects safe practice;
cooperate with reasonable competency reviews, feedback and remedial requirements;
communicate honestly about their qualifications, certification, membership and experience;
avoid guarantees, cure claims, exaggerated outcome claims or other misleading statements about TRTP; and
avoid conduct that may place clients, the public or the integrity of TRTP at unreasonable risk.

TTT may reasonably require a student or practitioner to undertake further:

education;
skills review;
mentoring;
refresher training;
assessment; or
reassessment.

Such action may be required where a genuine competency, safety, conduct, confidentiality or brand-integrity concern has been identified.

19. Suspension or Withdrawal of Certification and Permissions

TTT may investigate a concern relating to a student's or practitioner's:

competence;
conduct;
client safety;
confidentiality;
privacy;
professional representations;
certification status;
membership status;
assessment conduct;
use of Course Materials;
use of Approved Brand Assets; or
use of other TRTP IP.

Where reasonably justified, TTT may:

issue a warning or correction direction;
require remedial action, mentoring, training or reassessment;
suspend access to the Program, portal, community or support services;
suspend permission to work with certification clients;
suspend or withdraw practitioner certification;
suspend or cancel membership;
suspend or terminate permission to use Approved Brand Assets;
suspend or terminate permission to use Course Materials professionally;
remove or suspend a practitioner directory listing; or
terminate the person's participation in the Program or Certification Pathway.

Grounds for action may include:

a serious or repeated breach of these Terms;
unsafe, unlawful, unethical or materially incompetent practice;
false or misleading representations about training, certification, membership or outcomes;
misuse of TRTP IP, Course Materials or Approved Brand Assets;
a serious breach of privacy or confidentiality;
dishonest conduct in connection with training, client work or assessment;
failure to comply with a reasonable corrective or remedial requirement;
conduct likely to cause material harm to a client or participant;
conduct likely to cause material and unjustified damage to the reputation or integrity of TRTP; or
failure to satisfy the continuing conditions applicable to certification or use of TRTP IP.

Except where immediate interim action is reasonably necessary, TTT will:

provide the person with notice of the concern;
provide a reasonable opportunity for the person to respond;
consider the available information and the person's response; and
provide notice of the final decision and any resulting requirements.

If certification is suspended, the person must immediately stop:

providing or advertising TRTP services;
using Course Materials with clients;
using current practitioner titles;
using Approved Brand Assets; and
representing themselves as currently certified by TTT.

If certification is withdrawn, any professional-use permission associated with certification ends.

If Active Membership expires or is cancelled, the practitioner brand licence and current practitioner representation rights end automatically, even if the person's underlying Certification Certificate has not been withdrawn.

If certification, membership or brand-use permission is suspended, cancelled or withdrawn, the person must comply with TTT's reasonable directions concerning:

practitioner titles;
directory listings;
Approved Brand Assets;
Course Materials;
client communications; and
public representations.

20. No Guarantee of Certification, Outcomes or Commercial Success

TTT does not guarantee that every student will:

complete the Program;
pass a training or certification assessment;
achieve practitioner certification;
maintain certification or Active Membership;
achieve a particular client result;
attract a particular number of clients;
earn a particular level of income;
obtain professional registration, association membership or insurance; or
achieve any particular professional or commercial outcome.

Client outcomes depend upon a range of factors, including:

client circumstances;
client suitability;
practitioner competence;
professional judgement;
informed consent;
client participation;
the therapeutic relationship;
environmental circumstances; and
matters outside TTT's control.

Nothing in these Terms excludes, restricts or modifies any statutory right, consumer guarantee or remedy that cannot lawfully be excluded, restricted or modified.

21. Updates to Standards and Guidelines

TTT may reasonably update:

administrative and operational procedures;
assessment and certification guidelines;
client safety and recording requirements;
the TRTP Code of Conduct;
membership requirements;
brand guidelines and Approved Brand Assets;
portal and technology requirements;
privacy and information-security procedures; and
professional and competency standards.

Material updates will be communicated to affected students or practitioners.

Where reasonably practicable, TTT will provide appropriate transitional arrangements for existing students.

Current brand guidelines and current Approved Brand Assets apply to all ongoing public use of TRTP practitioner branding.

TTT may require outdated logos, badges, templates or representations to be replaced within a reasonable period.

A material variation that substantially and adversely changes a person's existing contractual rights will not be applied retrospectively unless:

the change is required by law;
the change is reasonably necessary to address client safety, confidentiality, professional integrity or intellectual property risk; or
the change is separately agreed with the person.

22. General Terms

These Terms, together with the separately accepted Payment Agreement and Financial Terms and Conditions, the separate Immediate Access and Change-of-Mind Refund Acknowledgement and any documents expressly incorporated into them, form the agreement between you and TTT in relation to the Program.

Where there is an inconsistency relating specifically to:

course fees;
deposits;
payment plans;
failed or overdue payments;
cancellations;
refunds; or
deferments,

the separate Payment Agreement and Financial Terms and Conditions will apply to the extent of that inconsistency.

Where there is an inconsistency relating specifically to the consequences of immediate access to the complete Core Training Materials, the separate Immediate Access and Change-of-Mind Refund Acknowledgement will apply to the extent of that inconsistency.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary, and the remaining provisions will continue to apply.

A failure or delay by TTT in enforcing a provision does not waive TTT's right to enforce that provision later.

The obligations concerning the following matters continue after the Program or your relationship with TTT ends:

confidentiality;
privacy;
client recordings;
TRTP IP;
Course Materials;
Approved Brand Assets;
accurate public representation;
withdrawal and cessation of professional use; and
any financial obligation that remains payable.

Headings are included for convenience and do not limit the interpretation of these Terms.

A reference to written permission or written notice includes permission or notice provided by email or through another electronic communication method approved by TTT.

23. Agreement Acceptance

By completing and submitting this application, you:

accept and agree to these Terms and Conditions;
confirm that the information you have provided is true, accurate and complete to the best of your knowledge;
confirm that you have read and understood these Terms;
confirm that you have read and understood the separate Payment Agreement and Financial Terms and Conditions;
acknowledge that the separate Immediate Access and Change-of-Mind Refund Acknowledgement must be accepted before portal access is activated;
agree to comply with the TRTP Code of Conduct and applicable Program requirements;
acknowledge that completion of the Formal Training Component provides a Completion Certificate and does not constitute practitioner certification;
acknowledge that practitioner certification requires completion of ten client cases and successful assessment of the required tenth-client recording;
acknowledge that current practitioner titles, logos, practitioner badges and Approved Brand Assets may be used only by a Certified Practitioner with an Active Membership;
acknowledge that access to Course Materials does not provide an unrestricted right to use TRTP with clients;
acknowledge that cancellation, withdrawal or failure to complete the Program does not preserve permission to use TRTP Course Materials, scripts or methodology professionally; and
agree that your electronic submission and acceptance have the same effect as signing this agreement, to the extent permitted by law.
