These terms and conditions (terms) form part of your enrolment application and you agree to be bound by these terms when you submit your application for enrolment. Nothing discussed verbally or electronically before or after your application, will apply.

1. Interpretation

   1. Any reference to or the words TTT, we, us, or our means Trauma Therapy Training Pty Ltd (TTT) ABN 41 162 600 964 and includes our associates, officers, employees, agents, successors, and assigns.

   2. TRTP means The Richards Trauma Process.

   3. Reference to you, your, student, or practitioner, refers to you. You are bound personally by these terms.

2. Before Completing your Enrolment Application

   1. Before participating in the UCB Empowerment Program, please consult your general practitioner or healthcare professional for your own safety, as this training includes personal discovery and first working through the trauma process for yourself. We cannot control how you may react when personally working through the TRTP process, so it is important that you seek additional professional support wherever required. We recommend you establish this additional support before you proceed.

   2. The UCB Empowerment Program is best suited for use by experienced mental health and health practitioners with mature, genuine intent to support their clients.

   3. The UCB Empowerment Program is a 5-week program consisting online study, Online zoom calls and a 5 hour online Zoom workshop

   4. Before making your application, please ensure you are available to attend and complete all course requirements and attend all training dates.

   5. We reserve the right to refuse anyone entry into the course, and to dismiss anyone from the course. A person could be dismissed, for example, for being disruptive, having unpaid or overdue fees, or for other reasons which may include, without limitation, exhibiting behaviour that reduces the effectiveness of the course (such as failing to attend course activities).

3. Upon Successful Completion of UCB Empowerment Training

   1. Upon successful completion of UCB Empowerment Training:

      1. you will receive a certificate of participation in the training;

      2. You are entitled to use the UCB Empowerment logo

   2. You are able to apply to enrole in TRTP Training for session 2&3 to become a TRTP certified practitioner

4. Relationship between the parties

   1. Your relationship with us is that of a student practitioner and provider of services. Nothing in this agreement establishes or deems you or any of your employees or associates, to be an employee, agent, partner, or trustee of TTT. This agreement does not create any legal relationship other than a contractual one on the terms of this agreement.

   2. As a student, you must not hold yourself out as being a TRTP practitioner, nor an employee or representative of TTT.

5. Student Obligations

   1. Students will:

      1. be considerate of and respectful to trainers and other students;

      2. behave professionally;

      3. accept responsibility for your actions;

      4. be open to constructive feedback;

      5. maintain confidentiality;

      6. pay all fees on time;

      7. be punctual for all training sessions; and

      8. abide by TRTP Code of Conduct [insert link].

   2. It remains your primary responsibility to ensure you comply with any applicable therapeutic legislation and codes affecting your specific practice, services or product whilst completing the training.

6. Payment terms

   1. To secure your place in the UCB Empowerment Training Program and to indicate your acceptance of these terms, you must pay a deposit of 50% of your Course Fees, as set out in the Application Form.

   2. The final balance of the remaining 50% of the course fees will be due before the course commencement, in accordance with your initial inquiry.

   3. An early bird discount may be applied for full payments received at least 30 days or more before course commencement. Any other discounts are at our sole discretion.

   4. You are responsible for all your own out of pocket expenses including any required stationery, transport, accommodation, internet connection fees and any other costs you may incur to complete the training.

7. Cancellation and Refund Policy

   1. If we are required to cancel the dates of your training program for any reason, the fees received from you will be refunded, or you may request that we transfer your payment to the next available training program. No compensation will be payable to you for any other expenses you may have incurred in arranging to attend that training.

   2. The grant of a refund is subject to Australian Consumer Law (ACL) and the terms and conditions of this agreement. This agreement does not seek to limit the ACL in any way.

   3. You understand that by enrolling into our TRTP Training Program, you warrant you have the capacity to attend the selected program for the course duration, including attending the course intensive days. We allocate resources based upon your enrolment confirmation.

   4. Cancellations by you up to 90 days or more before the training program commencement date will be eligible for a full refund, less an administration fee being of $300 or any higher administration fee set out in the Application Form.

   5. Cancellations by you less than 90 days before the training program commencement date will attract a cancellation fee equivalent to 50% the full course fees. The difference between that amount and the payments received from you will be refunded.

   6. As resources and course materials are allocated prior to the course commencement, cancellations from the training program commencement date cannot be refunded, except in accordance with the ACL.

8. Rescheduling and Deferment

   1. Courses are delivered flexibly, with core components to be completed on dates mutually agreed. You must work to ensure all course components are completed within the timeframe of the UCB Empowerment Training Program you have enrolled in.

   2. For circumstances beyond our control, we may be required to reschedule parts of training programs. We will make every effort to notify you as soon as possible if occurs. No compensation will be paid to you if we must reschedule.

   3. If you need to defer your TRTP Training Program, you must apply in writing and each application will be considered separately. Deferments must be requested for a period of no less than 30 days prior to the course start date.

   4. If your application for course deferment is accepted, you agree to pay an administration fee equivalent to 10% of the full course fees in order to be eligible to return to complete the course.

9. Photography and Digital Recording – Permission and Consent

   1. You will not record any part of UCB Empowerment Training Program in any format other than notes written by you (whether hard copy or electronic). Under no circumstances are Artificial Intelligence (AI) bots or similar permitted to transcribe meeting notes.

   2. By submitting this Application Form you consent to TTT recording in any format your student sessions and participation in TRTP Training Program for the purpose of assessment, evaluation and training.

10. Intellectual Property

    1. Intellectual Property means, but is not limited to all registered and unregistered trade marks, copyright, patents, service marks, designs, trade secrets, all course content in whatever format, treatment methods, teaching methods, methods of service delivery, name, branding, online platforms, forums and website content.

    2. Whilst a student you are granted non-exclusive, limited, and revokable license to use our intellectual property for the purpose of completing the program and will only retain the right to continue to use our intellectual property after completing or leaving the training at our discretion.

    3. You expressly and irrevocably agree that you must not display, distribute, modify, translate, reformat, incorporate into other works, promote, create derivative works, or in any way exploit or allow others to exploit our intellectual property in whole or in part, except as expressly authorised by us.

11. Privacy

    1. We take privacy seriously. You are required to read and you expressly and irrevocably agree to be bound by our Privacy Policy which can be found on our website or by using the following link: https://trtptherapy.com/privacy-policy/ . A breach of our Privacy Policy is a fundamental breach of this Agreement which may result in this Agreement being immediately terminated.

12. Confidentiality

    1. Confidentiality is important to us. Confidential information means any information obtained during the course of providing training services to you, including but not limited to all of TTT’s intellectual property.

    2. Confidential information also includes all information that:

       1. by its nature is confidential;

       2. is designated by the disclosing party as confidential; or

       3. the recipient knows or ought to know is confidential.

    3. You agree to keep confidential information confidential at all times and will not at any time, directly or indirectly:

       1. disclose or permit any such confidential information to be disclosed to any person; or

       2. use confidential information to the detriment of the disclosing party,

       3. except:

          1. to the extent required by law;

          2. to the extent the confidential information is already known to the recipient on the date of receipt or is already public knowledge without a breach of this clause; or

          3. as is authorised in writing by the other party.

    4. The obligation to maintain confidentiality continues after the termination of this agreement.

13. Dispute Resolution

    1. Should you have any concerns regarding your participation in the training, you agree to raise those concerns with us first. If we are unable to resolve your concerns, you acknowledge that any further action can only be taken against TTT and you hereby waive any and all rights to take action against any officers, employees, agents, trainer, mentors or other participants in your TRTP Training Program. You acknowledge that this provision may be pleaded as a bar to action by any of those persons should you seek to take action against them.

    2. Any dispute arising out of or relating to this agreement which cannot be resolved within fourteen (14) days by negotiation between the parties will be submitted to mediation.

    3. If the parties cannot agree on a mediator or the fee of mediation, the mediator will be selected, and the fee determined by the Chair of the Resolution Institute (https://www.resolution.institute) or his/her nominee. The following rules apply:

       1. Each party will bear their own costs of the dispute and share equally in the costs of the mediator and any required venue.

       2. The mediation will be governed by the Resolution Institute Mediation Rules.

       3. The mediation will be conducted by a single mediator independent of the parties and at a fee agreed by the parties.

       4. The seat of the mediation will be Brisbane, Queensland, Australia, unless otherwise agreed by the parties. The mediation may be conducted electronically.

14. Insurance

    1. Our insurances cover our trainers and the UCB Empowerment Training Program. For the purposes of our training program, we will maintain all insurances necessary and appropriate to the provision of our training services.

    2. It is your responsibility to maintain all insurances necessary and appropriate to your provision of any services to your own clients, such as public liability and professional indemnity insurance. You must seek and maintain, at your own risk and cost, all reasonable professional negligence insurance, worker’s compensation insurance, motor vehicle insurance, public liability insurance and all other relevant insurances.

15. Indemnity

    1. To the extent that our negligent act or omission has not contributed to the loss, you agree to indemnify and defend us from any claims, damages, liabilities, costs, or expenses (including without limitation court costs, collection costs, and reasonable legal fees) related to:

       1. your use of our UCB Empowerment Training techniques outside of our UCB Empowerment Training Program;

       2. your breach of this agreement.

16. General

    1. Clauses in this agreement designed to continue after termination will continue. For example, your obligations regarding confidential information and indemnities will continue even after this agreement has ended.

    2. Any variation to this agreement will not be valid unless it is in writing and agreed by both parties.

    3. Words used in the schedule have the same meaning when used in the terms and conditions.

    4. This agreement is governed by the laws of Queensland, Australia and you agree to submit to the non-exclusive jurisdiction of the courts of the State of Queensland, Australia, in the event of a dispute.

    5. Any time or other indulgence granted by us to you will not in any way amount to a waiver of any of our rights or remedies.

    6. If any of these terms and conditions are determined to be invalid or unenforceable, then the invalid or unenforceable provision will be severed, and the remainder of the terms and conditions will continue in effect.

    7. The parties agree this agreement may be signed electronically and a typed name or signature will be accepted and binding to the same extent as a hand-written signature.
